This seminar will assist you in more fully understanding the ethical issues regarding all Real Estate Relationships, including Buyer’s Agent, Seller’s Agent, Dual Agency, Designated Agency, and working as a Transaction Broker. You will learn how to read and understand the New Jersey Association of Realtors Consumer Information Statement. Furthermore, you will be advised on the form, substance, and ethical issues regarding the form Listing Agreement, NJAR Exclusive Buyer’s Agency Agreement, Dual Agency, and Consent to Designated Agency.

This seminar will assist you in more fully understanding the effects of the American with Disabilities Act, the Fair Housing Act and the New Jersey Law Against Discrimination as they relate to animals in housing in the State of New Jersey. You will learn the basics of the Acts, the classes of people and animals that they protect (and do not protect) and the legal restrictions and duties of Sellers, Buyers, Landlords, Tenants and Realtors. Additionally, the instructor will advise you on the types of Realtor behaviors that are legally prohibited and how to protect oneself from unlawful acts. Lastly, the instructor will provide examples of fact patterns that do and do not rise to the level of discrimination under the Acts.

This seminar will assist you in more fully understanding the effects of the New Jersey Bulk Sale Act as they relate to real estate transactions in the State of New Jersey. You will learn the basics of the Act, the classes of people and entities it places liability on and those exempt, and the property legal process to protect Buyers from Seller’s liabilities post-closing. Additionally, the instructor will advise you on the types of Realtor actions that will assist in ensuring a timely closing, while providing protection for their Buyer clients and no surprises following closing for their Sellers. Lastly, the instructor will provide examples of fact patterns and examples of the proper forms to supply to the State of New Jersey

This seminar will assist you in more fully understanding the effect of the Mount Laurel Doctrines, the Fair Housing Act, COAH, and the process of transferring affordable housing in the State of New Jersey. You will learn the history of the Mount Laurel cases (and their effect on affordable housing), the subsequent Fair Housing Act and the implementation of case law and statute throughout the State. Additionally, your instructor will advise you on the process of selling and purchasing these types of homes. The differences in determining eligibility for your clients, Contract phases, mortgage approvals that affect realtors, and the ultimate transfer of these properties. Lastly, the instructor will provide specific examples of fact patterns for these types of transactions.

This seminar will assist you in more fully understanding the effects of the updated Lead-Based Paint requirements on residential real estate in New Jersey. You will learn about the new requirements of the State, the inspection requirements, municipal approval for same, as well as remediation processes. Additionally, the instructor will advise as to municipality specific requirements and approved vendors for inspections and remediation’s. Lastly, the instructor will describe the New Jersey Statutes that control Lead-Based Paint.

This seminar will assist you in more fully understanding the effects of Estates on a real estate transfer in New Jersey. You will learn about the process of the initial Estate documents that have an effect on real estate transfers such as a Will or Power of Attorney. Additionally, the instructor will review the Surrogate process that allows parties and realtors to transfer a property following the passing of an individual such as Letters of Administration or Letters Testamentary. Furthermore, the instructor will review the process of a Seller for the Inheritance Tax Waiver (or related escrow) that is necessary to transfer a property in an estate.

This seminar will assist you in more fully understanding the effects of Solar Panels on real estate transfers in New Jersey. You will learn the preliminary documents, agreements and procedures when solar panels are present on a home. Additionally, you will learn the effects of the Uniform Commercial Code (and its related title issues) on these types of homes. Furthermore, the instructor will review the Realtor form amendment and the standard modifications to same on a case by case basis. Lastly, the instructor will describe the differing processes when the solar is owned, financed or leased.

This seminar will assist you in more fully understanding the effects of Underground Storage Tanks on real estate transfers. This seminar will firstly describe the basic provisions of the Real Estate Form Contract in detail. The instructor will describe the steps in legally removing an UST from a property. He will then detail the difference in procedures as to whether or not contamination was found. If contamination is at issue, the instructor will describe the process of obtaining the No Further Action Letter from the NJDEP. Additionally, the instructor will describe the various Contract provision settlements regarding closing with a UST in place (escrows, undertaking agreements, etc.)

This seminar will assist you in more fully understanding the effect of the Fair Housing Act and its progeny on real estate transfers in New Jersey. You will learn the basics of the Act, the classes of people it protects, the ethical restrictions on acts of Sellers, Landlords, Realtors, etc. and the prosecution tools of HUD and the Courts in enforcing the laws and regulations. Additionally, your instructor will advise you on types of Realtor behavior that are ethically prohibited and how to protect oneself from possible Fair Housing Act complaints. Lastly, the instructor will provide specific examples of fact patterns that do and do not rise to the level of discrimination under the Act.

This seminar will assist you in more fully understanding the ethical implications and possible ethical issues regarding Dual Agency and working as a Transaction Broker. You will learn how to read and understand the New Jersey Association of Realtors Consumer Information Statement on Dual Agency and Transaction Brokers. Additionally, you will be exposed to and advised on the form, substance and ethical issues regarding the two dual agency consent documents for both the Buyer and the Seller. Furthermore, you will be advised on the form, substance and ethical issues regarding the form Listing Agreement and form Buyer’s Agreement from NJAR as they relate to Dual Agency. Lastly, by way of example, we will demonstrate some additional documents that have been produced by various real estate brokerages and help to curb ethical exposure and liability regarding other affiliated business such as affiliated lender and title companies.

This seminar will assist you in more fully understanding the basics of Landlord/Tenant Law in the context of a Real Estate transfer. You will learn how to read and understand the Realtor Form Contract tenancy provisions and compare and contrast to the New Jersey Anti-Eviction Act. Additionally, your instructor will advise you on the custom contractual provisions which can protect both a Buyer and a Seller from miscommunications or undeliverable promises during Contract negotiations. Lastly, the instructor will demonstrate, by example, the correct process of setting up a real estate contract when there are tenancy matters involved.

This seminar will assist you in increasing familiarity with the Real Estate Sales Contract and Addenda. Detailed review of contract clauses, responsibilities, contingencies and amendments will assist in completion of contracts based on individual client situation.

This seminar will assist you in more fully understanding the Attorney Review process in New Jersey. You will learn about technical service and Contract terms regarding the review process. Additionally, your instructor will advise you on the standard modification made to the Realtor Form Contract. Furthermore, your instructor will advise you on common, but not standard, modifications to the Realtor Form Contract, such as Use and Occupancy Agreements, term changes from differing types of Sellers, etc. Lastly, the instructor will advise you on the completion of attorney review and rights and duties of all parties as the Contract becomes binding.

This seminar will assist you in more fully understanding the closing process in New Jersey. You will learn how to read and understand Loan Estimates, Closing Disclosures and ALTA form Settlement Statements. Additionally, your instructor will advise you on the Consumer Financial Protraction Bureau rules that promulgated these forms. Furthermore, your instructor will advise you on the National Association of Realtors position on the rule change as well as their influence upon the final rule. Lastly, the instructor demonstrate, by example, a residential real estate closing from the Buyer’s and Seller’s perspective.

This seminar will assist you in understanding the post-foreclosure sale process and the responsibilities of a Realtor with an REO transaction. You will learn about Post Foreclosure Transactions (REOs) and how they affect you, the Buyer, and the Seller. You will be able to identify when an REO is preferable and how to navigate through streams of documentation required for an REO purchase. In addition, the REO Addendum and the differences in Contract terms, Buyer and Seller responsibilities and timelines will be detailed.

This seminar will assist you in understanding the legal requirements of a Short Sale. You will learn about Pre Foreclosure Transactions and Short Sales and how they affect you, the Buyer, and the Seller. You will be able to identify when a Short Sale is feasible and how to navigate through streams of documentation required by lender.
